Facilities Use Policy Agreement

1.0 Limited License Granted

If the Event Request is approved, GBC grants the Client a limited, revocable, non-transferable, non-exclusive license during the Term to the extent described in the event details below.
2.0 Authorized Purpose If the Event Request is approved, the Client may access the GBC Facilities and Grounds to host the event described in the event details below.
3.0 Prohibited Activities

The Client may not:

  • Use hazardous materials not pre-approved by GBC.
  • Violate any laws or GBC/NSHE policies.
4.0 Authorized Personnel

Access is limited to those listed as authorized by the Client in the list of authorized attendees below.

5.0 Scheduling

Client agrees to abide by any scheduling conditions that are provided by GBC.

6.0 Term

The limited license granted to Client is valid only during the event dates listed in the event details. The license expires automatically once the event date passes.

7.0 Fees

Client agrees to pay the appropriate fee pursuant to the GBC Facility Use Rate Structure. Client agrees to pay the fees in full in advance of the Event.

8.0 Termination

Either Party may terminate with (7) days’ written notice. GBC may terminate immediately for breach or safety violations. Upon termination, the Client shall leave the Facilities in a clean, undamaged condition and return all borrowed items.

9.0 Client Liability and Damages

The Client agrees to report all damages, repairs, clean-up, and losses caused by their use of the Facility, Grounds, and Equipment. This includes costs associated with the misuse, improper storage, or disposal of materials.

10.0 Insurance
The Client must maintain and provide a copy to GBC:

Workers’ Compensation and Employer’s Liability Insurance

Contractor shall provide proof of workers’ compensation insurance as required by NRS 616B.627 or proof that compliance with the provisions of Nevada Revised Statutes, Chapters 616A-D and all other related chapters, is not required. If work occurs outside of the State of Nevada, by employees who do not live and work in Nevada, proof of the applicable statutory state’s workers’ compensation insurance must be provided.

Employers’ Liability.

  • $1,000,000 per accident or disease.

Commercial General Liability Insurance.

Minimum limits required:

  • 2,000,000 General aggregate.
  • 1,000,000 Products & completed operations aggregate.
  • 1,000,000 Personal and advertising injury.
  • 1,000,000 Each occurrence to include bodily injury and property damage. 

General Requirements. 

Additional Insured: By endorsement to all liability policies, except Professional Liability, GBC shall be named as additional insureds for all liability arising from the contract using the applicable ISO endorsement CG form. The endorsement form must be included with the Certificate of Insurance.

Waiver of Subrogation: Each liability insurance policy, including workers’ compensation, shall provide for waiver of subrogation against GBC.Proof of insurance must be submitted before use. Failure to maintain coverage is grounds for immediate termination. 11.0 Indemnification

The Client shall indemnify, defend, and hold harmless GBC, NSHE, and their agents, officers, and employees from all claims, liabilities, losses, and damages resulting from the Client’s activities, including personal injury, property damage, or violations of law or this Agreement.

12.0 Use at Your Own Risk

Facility and Equipment are provided “AS IS.” GBC makes no warranties regarding the condition, safety, or suitability of its products. Use is at the Client’s sole risk. GBC is not liable for any indirect, incidental, or consequential damages.

13.0 Client Property

GBC is not responsible for lost, stolen, or damaged client property.

14.0 Publicity

Neither Party may use the other’s name, logo, or identity in promotional material without prior written approval.

15.0 Force Majeure

Neither Party shall be liable for failure to perform due to causes beyond their control (e.g., natural disasters, pandemics, government action).

16.0 Governing Law and Venue

This Agreement is governed by Nevada law. Legal disputes will be handled in Elko County.

17.0 Sovereign Immunity

Nothing in this Agreement waives any rights or defenses under NRS 41.0305 to 41.039, including GBC’s sovereign immunity.

18.0 Entire Agreement and Modifications

These online terms are the full Agreement between the Parties and may be modified only in writing signed by both Parties.

19.0 Execution

Client agrees that their acceptance of terms using this electronic form is valid and binding in the same manner as if an ink signature were obtained.

Exhibit A – Code of Conduct and Safety Procedures

Code of Conduct and Safety Procedures:

Client agrees to act in accordance with the following Rules of Conduct (the “Rules”), and all relevant federal, state, and local laws and regulations. GBC may modify the Rules by providing updated or additional Rules.

The Grounds are designed to provide a professional, safe, and collaborative environment.  Users are responsible for reporting any damage they cause to the Grounds or its equipment and materials. Prohibited items include controlled substances or alcohol.

Users have non-exclusive use of designated common areas during approved hours. Grounds personnel may enter any area for emergency, repair, inspection, cleaning, or maintenance.

Users must not use the name or logos of GBC or NSHE in advertising without prior written consent from GBC’s Office of Marketing and Communications.

Users are Required To:

 
  • Keep their assigned space clean and organized.
  • Dispose of trash properly.Avoid sleeping or lodging on premises.
  • Park only in designated parking areas.
  • Refrain from excessive noise or disorderly conduct.
  • Avoid bringing animals, except for service animals.
  • Avoid hazardous materials or devices without written GBC approval.
  • Ensure hallways, stairwells, and emergency exits remain unobstructed.
  • GBC is not responsible for any lost, damaged, or stolen property.
  • These rules are subject to revision by GBC as needed for safety, cleanliness, and appropriate use of the facility or grounds.

Exhibit B – Waiver of Liability

1. Safety and Conditions of Use

I am personally responsible for my safety and actions while working on GBC Grounds. I agree to use the Grounds tools, equipment, and materials safely and to utilize safety gear for all activities. I will not use any equipment requiring prior certification unless I have received such certification from Facility personnel.

2. Assumption of Risk

I understand that activities on the GBC Grounds may present certain hazards, including, but not limited to, the risk of physical injury, electrical hazards, and exposure to dangerous materials. I voluntarily accept and assume all associated risks, including the possibility of serious injury or death.

3. Release of Liability

I, on behalf of myself, my estate, and my representatives, release and discharge the Board of Regents of the Nevada System of Higher Education, Great Basin College, and their officers, employees, and agents from any and all liability, claims, or demands related to injury or property damage resulting from work on the Grounds.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, damage, or expense, including attorney’s fees, that may arise from my actions or omissions.

Unsubmitted documents may result in processing delays. A Certificate of Insurance (COI) is required for all external events held at GBC.
